Waiver and Release of Liability
I understand and acknowledge that sailing can be a hazardous activity with inherent risk of damage, injury, and death. I understand and acknowledge that the race organizers have no ability to control the conditions in the racing and other areas involved in the event, including without limitation the wind, water, and weather conditions, and the presence of natural and man-made hazards and boat traffic. I have reviewed, am familiar with, and will abide by the Racing Rules of Sailing, including Rule 4 of the Fundamental Rules which provides that “[t]he responsibility for a boat’s decision to participate in a race or to continue racing is hers alone.” I will at all times exercise my own independent judgment in determining whether conditions are safe for me, my crew, and my vessel to be on the water or racing, and as to what additional personal safety gear beyond any minimum requirements may be appropriate for those conditions. I am participating in this Event voluntarily and entirely at my own risk, and I accept full responsibility for any injury to myself or damage to my property sustained as a result of my participation in this Event.
I hereby waive any rights I may have to sue the Hood River Yacht Club, the instructors, officials, sponsors, volunteers or any other organization or person involved with this Event (collectively, the “Organizers”) with respect to death, personal injury, or property damage suffered by myself as a result of my participation in this Event, and I hereby release the Organizers from any liability for such death, injury, or damage to the fullest extent permitted by law.
I understand this document has important legal consequences, and my acceptance means that I have read, understood, and agree to the above terms and conditions.
