2024 Sail East at Bay Wind Regatta - St Margaret Sailing Club Participant Release This release must be provided for all competitors (skipper, crew, or coach). For participants under age 18 at the start of the regatta, it must be signed by a parent or guardian. Waiver: Please be aware: by agreeing to this document you are waiving certain legal rights, including the right to sue. Please read and be certain you understand the implications of signing this document. I do hereby affirm and acknowledge the inherent hazards and risks associated with sport & sailing activity. I fully understand that these risks can lead to severe injury and even death. In consideration of permitting the participant to participate in sport activity or related operations conducted by the facility of Sail Canada, Sail Nova Scotia, and the St Margaret Sailing Club, I, for myself, my personal representatives, heirs and next of kin do HEREBY acknowledge that SPORT ACTIVITY IS A POTENTIALLY DANGEROUS ACTIVITY and involves the risk of serious injury and/or death and/or property damage; HEREBY RELEASE, WAIVE, DISCHARGE AND AGREE NOT TO SUE Sail Canada, Sail Nova Scotia, St Margaret Sailing Club, its facility, or any of its officers, instructors, agents or employees (the Releasees) from all liability resulting in any loss or damage, and any claim or demand therefore on account of injury to my person or property or resulting in my death, now and forever, arising out of or related to participation in said activities, or other related operations that may occur, whether caused by the negligence or the Releasees, or otherwise; I EXPRESSLY agree to INDEMNIFY and SAVE and HOLD HARMLESS the Releasees from any loss, liability, damage or cost that they may incur, now and forever, arising out of, or related to, participation in said activities, whether caused by the negligence of the Releasees, or otherwise; I have read the agreement, fully understand the terms herein, understand that I have given up substantial rights by signing it, am aware of its legal consequences, and agree to this document freely and voluntarily without inducement, assurance or guarantee being made to me. If applicable: as a parent or guardian of the participant, I agree to the terms of this document on behalf of my minor child and agree to be specifically bound to all the terms and conditions of this agreement.


Participant over 18 Consent to the Universal Code of Conduct to Prevent and Address Maltreatment in Sport 

“I hereby consent to being subject to the Universal Code of Conduct to Prevent and Address Maltreatment in Sport (the “UCCMS” available at https://sportintegritycommissioner.ca/uccms) and the processes required for its administration and enforcement. The purpose of the UCCMS is to advance a respectful sport culture that delivers quality, inclusive, welcoming and safe sport experiences. More specifically, I hereby consent to the collection, use and disclosure of my personal information in relation to the administration and enforcement of the UCCMS, as detailed more fully in the following document available at https://commissaireintegritesport.ca/files/Long-form_Consent_OSIC.pdf.” 
 

Consent to Sail Canada Code of Conduct 

“I hereby consent to being subject to Sail Canada Code of Conduct as well as all policies part of Sail Canada Safe Sport Policies Package (available at https://www.sailing.ca/policies-financials/#codeofconduct) and the processes required for its administration and enforcement. The purpose of Sail Canada Code of Conduct and policies part of the Safe Sport Policies Package is to advance a respectful sport culture that delivers quality, inclusive, welcoming and safe sport experiences. More specifically, I hereby consent to the collection, use and disclosure of my personal information in relation to the administration and enforcement of Sail Canada Code of Conduct as well as all policies part of Sail Canada Safe Sport Policies Package.” 

 

Reminder to your athletes & their parents: 

Competitors participate in the regatta entirely at their own risk. See rule 3, Decision to Race. The organizing authority will not accept any liability for material damage or personal injury or death sustained in conjunction with or prior to, during, or after the regatta. In participating in the event, a competitor automatically grants to the Organizing authority and the sponsors of the event, the right in perpetuity, to make, use and show, from time to time and at their discretion, any motion pictures, still pictures and live, taped or film television and other reproductions of him/her during the period of the competition for the said event in which the competitor participates and in all material related to the said event without compensation.
