Waiver

I intend to participate or volunteer in sailing races and related events sponsored or supported by Clagett Sailing, also known as C. Thomas Clagett, Jr. Memorial Clinic and Regatta, participating yacht clubs and sponsors (from here on known as: The Clagett). In consideration of my being permitted to participate or volunteer in The Clagett I hereby waive, release and discharge any claims, causes of action or any type of demand whatsoever against  the Clagett, participating yacht clubs, and sponsors including their respective officers, directors, agents, volunteers, or employees that I, my successors, heirs  or assigns  may have now, or in the future,  for any bodily injury of death I may suffer or for any damage to any boat or other property arising out of my involvement in any component of The Clagett including, but not limited to, any property owned or operated by the Clagett, and any activities sponsored by The Clagett.

I  acknowledge that participation in the sport of sailing or in the Clagett involves substantial risk of personal injury, Inherent in the sport of sailing is the risk of permanent, catastrophic injury or death by drowning, trauma, hypothermia or other causes or even death, and the undersigned hereby assumes all risk of any such injury to his or her body and mental health arising from practicing for or participating in The Clagett, and he/ she forever gives up and relinquishes any claim for liability against The Clagett, and participating yacht clubs, including their respective officers, directors, agents, volunteers, or employees, that I may have by reason of participating in the above event. This release incorporates, by reference, Section 7-6-9 of the General Laws of Rhode Island.   

I will participate or volunteer in the regatta entirely at my own risk. See RRS 3, Decision to Race. The Organizing Authority, US Sailing and The C. Thomas Clagett, Jr. Memorial Clinic and Regatta and its officers, directors and employees, the event volunteers and officials, the event sponsors, and any other member of the regatta shall not be liable for material damage or personal injury or death sustained in conjunction with or prior to, during, or after the regatta. This waiver of liability shall be signed by all competitors and shall be considered a regatta governing document of The Clagett. 

I grant, in perpetuity to The C. Thomas Clagett, Jr. Memorial Clinic and Regatta the absolute right and permission to use my name, voice, image, likeness, and biographical material, as well as representations of the boats in any media world-wide (including television, print and internet media), including video footage, for the sole purposes of advertising, promoting, reporting and disseminating information regarding The C. Thomas Clagett, Jr. Memorial Clinic and Regatta and my participation in the event.
